[The Club Bye-Laws are reviewed periodically and subject to amendment from time to time and are
therefore provided in loose-leaf form for members to retain with their copy of the Club Constitution]
1 MEMBERSHIP
a) Entrance Fee, Deposit Fee and Subscription Rates [Plym Yacht Club Constitution Rule 2.13 refers] for each category of membership shall be as follows:
Entrance Fee (Voting membership): £20.00 [Junior membership £10.00]
[Not applicable to Cadet, Overseas, Temporary or Associate/Joint Associate membership]
Deposit Fee (Associate/Joint Associate membership): £20.00
Subscription Rates:
The rates are reviewed annually and are reported in the minutes of the Annual General Meeting, displayed in the club premises and on the Plym Yacht Club website.
Notes:
[Junior entry to the upper age limit is subject to continuing full time education and Committee approval]
[For members’ eligible and claiming half rate, the subscription payable is half of the appropriate rate]
b) A list of applicants awaiting membership vacancies in order of application date shall be displayed on the Club notice board.
c) Any change in category of membership to include a new member, requires the original member to complete a new application form for publication and consideration by the Committee in the usual way.
d) The minimum age for application for Cadet Membership (not being part of a Family membership) shall be 11 years.
e) Temporary Membership shall be available at the discretion of the Committee and limited to 12 weeks in anyone year, at fee of £5.00 each week and Taster Temporary Membership shall be available at a fee of £20.00 non-returnable, once in any year, and limited to 4 weeks.
f) The Committee will consider a members' written request of 'exceptional circumstances', for a change from a voting entrance fee membership category to a non-voting/non-entrance fee category, in order to maintain continuous membership of the Club. If 'exceptional circumstances' are approved and the voting membership not considered as lapsed by the change, a further Entrance Fee will not then be required if the member subsequently requests re-entry to their former voting membership.
g) A former Entrance Fee (Voting membership) which has lapsed for 12 months or more will require an application for membership in the usual manner and full payment of all monies required. [Plym Yacht Club Constitution Rule 2.15 refers]
h) Late payment of subscriptions will not be accepted from any member who has not renewed their membership by the due date or any other date advised at the discretion of the Committee. The membership is considered as lapsed and a new application for membership must be made, UNLESS written explanation is first provided by the former member before 12 months from the due date have elapsed, to satisfy the Committee that a reasonable excuse prevented payment when due. j) Associate members and Joint Associate members may become full voting members of the Club
provided they complete the requisite application form which shall be approved by the Committee, and
make payment of the Entrance Fee for a full membership and if appropriate the difference in the rate of
Annual Subscription for the complete current membership year will be paid.
2 CADETS
a) Individual Cadet Membership applications, not being part of a Family membership, may be submitted in the same way as other applications for election to membership but will be seen by a nominated member of the Sailing Committee for consideration prior to countersignature in the Flag Officer section of the application.
b) Parents or Guardians of Cadets shall be responsible for them at all times when the cadet(s) are engaged in Club activities or on the Club premises and shall be answerable to the Committee for the Cadets' actions.
c) Cadets shall be allowed into the Bar area at the discretion of a Club Officer; the time(s) may be restricted.
d) Cadets under the age of 14 years and not accompanied by an adult must vacate the Club premises by 2200 hours unless prior arrangements have been made with a Committee member
e) DARTS OR OTHER OBJECTS LIKELY TO CAUSE DAMAGE OR INJURY TO MEMBERS OR PROPERTY ARE NOT TO BE USED in any Room of the Clubhouse during activities involving Cadets.
3 HOUSE
a) Opening Hours - Supply of Intoxicating Liquor: stated in Plym Yacht Club Constitution Rule 8.5.
b) NO PERSON UNDER THE AGE OF 18 YEARS SHALL PURCHASE OR CONSUME INTOXICATING LIQUOR WITHIN THE CLUB PREMISES.
c) In the interests of safety and keeping 'Fire Exits' CLEAR, parking in front of the Fire Exit of the Club is not permitted.
d) The Hon. Treasurer/Rear Commodore House shall present a report and financial statement for the preceding year at the Annual General Meeting, on behalf of the Wine Committee. [Plym Yacht Club Constitution Rule 8.2 refers]
e) The Wine Committee will pay all monies required to be paid to the House Secretary/Rear Commodore House/Hon. Treasurer acting on behalf of the Hon. Secretary who must be kept informed. [Plym Yacht Club Constitution Rule 8.2 refers]
f) No persons are permitted to serve or assist behind the Club bar without the prior approval of the Wine Committee and the Committee as submitted by the Rear Commodore House who administers the Bar on behalf of the Wine Committee and the Committee. All such persons receiving payment for the work will be required to complete an IRD P46 and to be paid through the payroll of the Club.
g) The Wine Committee of the Club, will during the Club year, meet at least on a quarterly basis, and make written activity report to the Committee, for approval as may be required.
h) Smoking is not permitted in the Club House.
i) Members will abide by the 1 metre rule (allowing access to the bar) when requested by the Bar Steward or a Committee Member.
4 USE OF THE CLUBHOUSE
a) On the occasion of Social Events for which tickets have been sold, parts of the Clubhouse shall be for the use of ticket holders only. The Committee shall determine the extent of any exclusion in advance and a prominent notice to this effect shall be displayed within the Club for three weeks before the event.
b) Upon the agreement of the Committee, for the use of the Club for non-club functions by members, a charge will be made. If the function(s) has an attendance of non-members a list of their names must be submitted to the Rear Commodore House for temporary membership at least 48 hours prior to the event.
c) When the Bar is used during a non-club function, a member of the Wine Committee or a delegated member must be present.
d) Upon the agreement of the Committee, the Club may be used without the bar facilities by members, non-members and non-sailing organizations for which a charge will be made.
e) Parents and Guardians of Children shall be responsible for them at all times.
f) Dogs brought into the Clubhouse must be kept on a lead and prevented from becoming a nuisance or hindrance to Club members.
g) Members shall give to the Events Secretary (or member of that Sub-Committee) a minimum of 48 hours notice of proposed non-attendance at any event in which they had previously registered a wish to be included. Failure to do so will render such members liable for full payment of the charge for the event,
at the discretion of the Committee.
5 ADMINISTRATION
a) The Club shall maintain an account at a reputable Bank or Building Society.
b) Any expenditure incurred by the Commodore or the Vice Commodore on hospitality and entertaining the Clubs' guests or visitors shall be reimbursed on request, providing that in any one year of office they do not jointly exceed an amount equal to three times the Annual Subscription for a Family Membership. Expenditure in respect of any special event or function may be treated as a special case at the Committee's discretion.
c) Donations by the Club to Charitable and Benevolent Organizations (Plym Yacht Club Constitution Rule 7.8 refers) - shall be at the discretion of the Committee. Such donations shall not exceed in total for any Club year, twice the Annual Subscription for a Family Membership.
d) Members who have any concern or complaint about the ongoing of the Club/Clubhouse should address the complaint, in writing, to the Hon. Secretary.
e) All communications, registrations and the like, concerning the ongoing of Plym Yacht Club must not be addressed to an individual members’ home address and must be addressed to Plym Yacht Club `for the attention of’ if required, and all agreements entered into by individual members acting on behalf of the Club, must be registered in the name of Plym Yacht Club unless there is a legal obligation not to do so, and addressed to Plym Yacht Club as before.
f) The Finance sub-committee of the Club will during the Club year, meet at least on a quarterly basis, and make written activity report to the Committee on each occasion, who will consider approval of expenditure's listed in accord with the information and guidance provided by the Finance sub-committee.
g) Expenditure for capital equipment and replacement equipment and for essential emergency repairs will be made only and strictly in accordance with the authorities and procedures set down in the Club Finance Policy document Annex B.
h) The facility of cashing cheques at the bar is allowed to members only, up to and including a limit of £30.00 in value only, on any day.
6. MOORINGS AND STORAGE
a) The Moorings Secretary shall administer the Moorings and Storage areas on behalf of the Club.
b) The temporary use of Moorings shall be at the discretion of the Rear Commodore Sail.
c) The occupation of moorings shall be on an annual basis.
d) No Member is allowed to Sub-Let Moorings under any circumstances.
e) Any Moorings not used for 12 months may be re-allocated at the discretion of the Committee.
f) The Moorings as allocated shall be charged as per the cost from the Cattewater Harbour
Commissioners plus a charge, as laid down by the Committee.
g) Only those members who have Full or Family memberships are eligible for Moorings.
h) In boat/yacht partnership cases, all participating partners must be Full or Family members of the Club; to be eligible for a mooring for the said part owned boat/yacht.
i) In no circumstances will the Club or its' Officials accept responsibility for any interest, actions, or any matters arising in the absence of Moorings Holders for their boat/yacht. All Moorings Holders must provide second reference for Emergency Contact. Any such arrangements that are made between the Mooring Holder and any other individual be they a Club member or not, is the sole responsibility of the parties concerned.
j) All mooring holders, in taking a mooring from Plym Yacht Club will declare full acceptance of the Special and General Conditions of the hire of the Cattewater Commissioners’ Moorings as currently in force and all the conditions of Plym Yacht Club as advised by the Moorings Secretary.
7. POLICY AND GUIDELINES
a) The Committee members shall be as follows:
House Secretary, Bosun, Yacht Secretary Cadet Secretary, Moorings Secretary, Events Secretary, Membership Secretary, Communications Secretary. [Plym Yacht Club Constitution Rule 2.14 refers]
b) Policy of the Club on Sailing for Cadets, Yachts, Safety Boats, Start Box, and Club Dinghies will strictly adhere to procedures laid down in the Club Sailing Policy Document Annex A.
c) Policy for Club financial control, shall adhere to the policy laid down in Club Finance Policy Document Annex B.
d) The Club IT systems will be operated by all members only and strictly in accordance the procedures laid down in the Club ICT Management Policy Document Annex C.
e) Child Protection. All members and other persons associated with the activities of the Club will strictly adhere to the Club Child Protection and Procedures Policy set out in Document Annex D.
f) Code of Practice for the Management of Asbestos in Buildings is contained in Annex E.
g) Policy of the Club for Complaints Proceedings. Meeting with Member reference Plym Yacht Club Rule 2.16 is laid down in Annex F.
h) Policy Statement of the Club on the secure storage, handling, use, retention and disposal if CRB Disclosures and Disclosure Information is laid down in Annex G.
i) A copy of all Policy Documents of the Club will be made available for members use in the Clubhouse.
